New regulation that contrasts with European laws
New incoming dispute between the carrier Ryanair and consumers, as the new "terms and conditions" for the purchase of the tickets show that in case of legal disputes customers will have to go to an Irish court. A decision that runs counter to the EU regulation 44/2001 for which the place of jurisdiction is that of the state in which the consumer is a citizen, who can also choose to turn to another court within the European Union. EU commissioner for Justice Vera Jourovà has lined up against this new clause and posted an appeal on "Twitter" for the authorities to act and clarify this decision.
Among the reasons for the decision of Ryanair there could also be purely economic issues, since the appeal is the second step after the first reimbursement request to be made on-line. Should this not be successful, the new regulation would oblige consumers to bear the costs for the appeal to be filed in Ireland, this could make them desist, and ensure that the airline does not have to reimburse the customer. A new element of problematic after the strikes this Summer and the decision to pay for hand baggage.
