EU rejects Lufthansa appeal: "Low-cost carriers were not favored"

This is the decision of Luxembourg court

The accusations made by the airline Lufthansa against low-cost carriers, Ryanair in the first place, were returned to the sender. The Court of Justice of European Union located in Luxembourg ruled on the statements of the German airline, according to which Berlin granted improper state aid by financing the Frankfurt-Hahn airport (read also the article published from AVIONEWS). Lufthansa became convinced that Berlin's economic support was instrumental in favoring low-cost carriers.

The recommendations of the Advocates General were precisely those not to follow up on the appeal and in 80% of cases this community court follows the reasoning of its consultants, a percentage that makes it clear how the sentence was expected. In Luxembourg, similar processes increased significantly in recent years, with State aid in various sectors characterizing legal discussions (see AVIONEWS). Among other things, it also happened that the EU magistrates addressed the European Commission directly as the body responsible for resolving such disputes. Paradoxically, Ryanair is one of the companies on the front line against these aids, in particular it has recently railed against those granted to Tap Air Portugal, as also detailed by AVIONEWS.
